For the vast majority of engineers, the work they are doing is governed, somewhere along the line, by a contract between a customer and supplier. If the work goes anything less than 100% according to plan: If there is a change in specification; a delivery date slippage; a cost over-run; then the contract is meant to determine the consequences. But just when should that contract be invoked, rather than the customer and the supplier just sorting out a practical answer to a practical problem? What are the consequences of invoking the contract? What are the consequences of not? This course has been designed specifically to introduce the Engineer to the legal concepts underpinning commercial contracting. What you will learn:
- Understand the legal consequences of your actions and decisions in dealing with customers and suppliers
- Avoid legal pitfalls
- Appreciate the consequences of non-conformance
- Use contracts to help you move projects forward
- How to recognise or anticipate contractual problems and know when to raise concerns or seek advice
Who Should AttendThis course is ideal for those senior engineers who have spent some years in contracting but never had any formal training in contract law, those who wish to have a refresher in the subject and those who are comparatively new to engineering and contracting and who need to understand the law within which they are working. It is equally of benefit to those who are involved in the procurement of goods, services and works and to those who are managing contracts – whether for a purchaser, main contractor, subcontractor or supplier.
About your FacilitatorGavin WeimanWith over 20 years experience in the legal field your dynamic and vastly experienced facilitator will equip you with extensive insight into business law essentials for managers. Your seasoned facilitator holds a BProc. Degree and appeared regularly in criminal and civil trial and motion matters, appeals and various applications and procedures. In 1981, he was admitted and qualified to the Transvaal Provincial division of the High Court of South Africa. He is currently involved in training development and consulting on commercial contracts management, contract law, procurement and legal management systems and business law.
